Send the borrower a short update at each milestone, send the agent only the milestones the borrower has authorized, and track the Closing Disclosure waiting period as its own date. GoHighLevel can run both audiences from the same opportunity. The bottom line: most closing delays are not surprises, they are a corrected Closing Disclosure that restarts a three business day wait, and a borrower who was told that early takes it calmly.

The rules that set the calendar

According to the CFPB's guides, the Closing Disclosure must be received by the consumer at least three business days before consummation, and a consumer is considered to have received it three business days after it is delivered or placed in the mail. The Loan Estimate must be provided no later than seven business days before consummation. If the Closing Disclosure changes, the creditor must provide a corrected one. The CFPB's FAQ says a new three business day wait applies when the change makes the APR inaccurate, when the loan product information becomes inaccurate, or when a prepayment penalty is added. For other changes, a corrected Closing Disclosure at or before consummation is enough. Electronic delivery has its own consent rules, so follow your lender's process for how the Closing Disclosure goes out.

Milestones and who hears about them

MilestoneBorrower hearsAgent hears (if authorized)
Appraisal ordered and receivedYes, with the dateYes, status only
Conditions cleared, clear to closeYesYes, status only
Closing Disclosure sentYes, with the date the three business days endYes, the earliest signing date
Corrected Closing Disclosure with a new waitYes, same day, by phone and textYes, the new earliest signing date

The agent hears the status, never the numbers. Loan amounts, rates, and the contents of the Closing Disclosure are nonpublic personal information. Get the borrower's authorization to share status with the named agent, record it on the file with the tag Agent updates authorized, and send agent messages only when that tag is present.

Build it in HighLevel

  1. Add opportunity fields for Closing date, Closing Disclosure sent, Earliest signing date, and Corrected Closing Disclosure reason.
  2. Calculate Earliest signing date in your loan origination system and enter it, since HighLevel does not know your business day calendar.
  3. Use the Opportunity Changed trigger on stage changes such as Appraisal received and Clear to close to send the borrower milestone texts.
  4. Use a Custom Date Reminder on Closing date at 10, 5, and 2 days before to create tasks for the loan officer and processor.
  5. Add an If/Else on the tag Agent updates authorized before any message to the agent, and send only the milestone sentence.
  6. Build a workflow for the field Corrected Closing Disclosure reason. If it says APR, product, or prepayment penalty, text the borrower and create a call task the same day for the loan officer to explain the new date.
  7. Turn on Stop on Response so questions go to a person.

Messages, written out

Borrower: Hi Dana, this is Sam at [Brokerage]. Your Closing Disclosure was sent today. The earliest signing date is April 24. I will call you tomorrow to go through it. Reply STOP to stop messages. Agent: Hi Chris, this is Sam at [Brokerage]. The Closing Disclosure for 14 Oak Street went out today, and the earliest signing date is April 24. Neither text names a rate, an amount, or a fee.

Worked example

A broker with 25 closings a month, where 4 percent need a corrected Closing Disclosure that restarts the wait, sees 1 closing a month move (25 times 0.04). A same day call turns that into a rescheduled closing the borrower and the agent already expected. The 4 percent is an assumption, so replace it with your own correction rate.

Privacy and consent

These texts are about the borrower's own loan, so they are informational, and they need texting consent and a registered number. The Safeguards Rule applies to the file, so keep documents out of text threads.

When the closing date moves

Closing dates move for reasons that have nothing to do with the Closing Disclosure: a title issue, a missing payoff letter, a seller who needs more time. Send three messages when it happens. First, a call from the loan officer to the borrower the same day. Second, a text with the new date once the call is done. Third, with authorization, a milestone update to the agent. Do the call first, since a text that moves a closing date reads as bad news with no explanation.

What the agent should not receive

Agents sometimes ask for the loan amount, the rate, or a copy of the Closing Disclosure to help a client. Those are the borrower's to share. The workflow sends the agent the date and the status only, and a loan officer handles any other request by asking the borrower. That rule protects the borrower and the brokerage, and it is easier to follow when the workflow never sends more.

How this was handled before

The loan officer called the borrower and the agent separately, and the agent often learned of a delay from the title company. One workflow keeps both audiences on the same facts.

What to measure

Track closings with an on time signing date, corrected Closing Disclosures that restarted the wait, same day calls made, and agents who needed a second update. The same day call rate is the number to hold at 100 percent.

Questions people ask

How long before closing must the borrower get the Closing Disclosure?

At least three business days before consummation, and a consumer is considered to receive a mailed or delivered Closing Disclosure three business days after delivery or mailing, according to CFPB guides.

When does a corrected Closing Disclosure restart the wait?

When the APR becomes inaccurate, the loan product information becomes inaccurate, or a prepayment penalty is added.

Can a broker update the real estate agent?

With the borrower's authorization, share milestone status only, not loan amounts, rates, or the contents of the disclosure.
