What the rules ask for
Two state bar opinions bear on an AI agent that talks to callers. The Florida Bar's Opinion 24 1 says a client facing chatbot must clearly say it is an AI and not a lawyer or firm employee, and that the lawyer is responsible if it creates a prospective client relationship. Oregon's Formal Opinion 2026 208, in a summary, says to disclaim that no attorney client relationship is formed, review conversations promptly, and have a lawyer approve autonomous actions such as sending an engagement letter. ABA Formal Opinion 512 covers confidentiality under Rule 1.6, which Rule 1.18(b) extends to prospective clients. Check your own state's opinions, and have ethics counsel approve the script.
Call recording is a separate issue. Eleven states, including California, Florida, Illinois, Pennsylvania, and Washington, require all parties to consent to recording, according to a summary from Rev, and some lists count 13. An AI agent that records or transcribes every call needs a spoken notice in the greeting.

For example, if a firm gets 12 calls a week after 5 p.m. and 4 are new matters, the agent books 4 consultations (12 minus 8 that are existing clients, wrong numbers, or sales calls). Two attorneys start Monday with a list instead of a voicemail box, and the urgent call goes to whoever is on call.

- Letting the agent answer legal questions. It should book, not advise.

Check before you switch it on
US text messages sent from a standard 10 digit number need A2P 10DLC registration. The HighLevel support portal says registration is required for texts to US recipients from 10 digit long code numbers and that toll free numbers do not require it.
